Agreement to terms.
These Terms & Conditions apply to all services provided by SkyInkCreations, including website development, software development, digital infrastructure, consulting, integrations, automation, hosting support, maintenance, retainers and related digital services.
By approving a proposal, requesting work, paying an invoice, paying a deposit, accepting a quote, entering a retainer, or continuing to use SkyInkCreations services, the Client agrees to these terms.
These terms apply to one-off projects, staged builds, retainers, support work, consulting and digital implementation unless otherwise agreed in writing.
Proceeding with payment, project approval or continued use of services confirms acceptance of these Terms & Conditions.
Project scope and deliverables.
Project deliverables are defined by the approved proposal, written quote, invoice, email agreement or project documentation provided by SkyInkCreations.
Any work not expressly included in the agreed scope is considered additional work and may require a new quote, variation, retainer allocation or separate invoice.
Scope includes only the deliverables clearly agreed in writing.
Additional pages, features, integrations, revisions, functionality or content may incur additional charges.
SkyInkCreations may decline out-of-scope requests unless they are formally approved and quoted.
Project direction changes may affect timelines, pricing and delivery structure.
Payments, deposits and invoices.
Payments are required in accordance with the agreed proposal, quote, invoice or retainer arrangement. Deposits are used to secure project scheduling, internal allocation, delivery capacity and opportunity cost.
SkyInkCreations may pause work, withhold delivery, suspend access, delay launch or restrict support if payments are overdue.
Secures scheduling, planning, resource allocation and delivery capacity.
Must be paid before work is allocated or commenced unless otherwise agreed.
Supports staged production, development and delivery progress.
Must be paid when due to avoid delays or suspension.
Secures recurring strategic, support or technical allocation.
Must be paid in advance unless otherwise agreed in writing.
Refunds and cancellations.
All payments made to SkyInkCreations are strictly non-refundable, including deposits, milestone payments, final balances, retainers and payments for software development, web development, consulting, integrations, hosting support or digital services.
Refund conditions are governed by the SkyInkCreations Refund Policy and any non-excludable rights under Australian Consumer Law.
Payments secure time, capacity, planning and delivery resources and are not refundable for change of mind, client delays or direction changes.
Clients should review the Refund Policy before making payments or commencing any engagement.
Client responsibilities.
The Client is responsible for providing accurate information, timely feedback, required content, access credentials, approvals, business details, brand assets and any materials needed for project delivery.
Delays caused by missing information, late approvals, unclear feedback, incomplete content or unavailable access may affect timelines and do not create a refund entitlement.
Provide required content, images, copy, login access and project details when requested.
Review work and provide consolidated feedback within reasonable timeframes.
Ensure all supplied content is lawful, accurate and authorised for use.
Confirm business, compliance, legal and industry-specific requirements before launch.
Approve final work before publication, deployment or launch.
Timelines and delivery.
SkyInkCreations provides estimated delivery timeframes based on project complexity, scope, client responsiveness, third-party dependencies, approval cycles and active workload.
Timelines are estimates unless expressly confirmed as fixed in writing. Delays may occur due to client-side delays, third-party platforms, integrations, technical issues, scope changes or late payments.
Delivery timeframes are based on available information at the time of project approval and may shift if conditions change.
Late feedback, missing content, unpaid invoices or withheld access can delay delivery without creating liability for SkyInkCreations.
Revisions and approvals.
Revision rounds, if included, are limited to the agreed project scope and are intended to refine approved direction rather than restart the project, redesign an entire concept or introduce new functionality.
Once a design, page, feature, stage or deliverable has been approved, additional changes may be treated as new work and quoted separately.
Revision requests must relate to the approved scope.
Major direction changes may be treated as a scope variation.
Approved work may not be reopened without additional cost.
Final approval authorises launch, delivery, handover or deployment.
Third-party platforms, services and costs.
SkyInkCreations may recommend, configure or integrate third-party platforms such as hosting, domains, plugins, apps, APIs, payment processors, CRM systems, email platforms, analytics tools, ecommerce platforms or software subscriptions.
Third-party providers are outside the direct control of SkyInkCreations. Their terms, pricing, availability, outages, policies, billing and technical limitations may apply separately.
The Client is responsible for third-party costs unless otherwise agreed.
Third-party outages, policy changes or billing issues are not controlled by SkyInkCreations.
Licenses, subscriptions, domains, hosting and external tools may require ongoing payment.
Third-party service failures may affect website, software or integration performance.
Ownership, access and intellectual property.
Ownership of final deliverables may transfer to the Client once all outstanding invoices and agreed payments have been paid in full, subject to any third-party licenses, platform restrictions, proprietary systems or pre-existing SkyInkCreations intellectual property.
SkyInkCreations retains ownership of internal processes, frameworks, code libraries, methodologies, reusable components, strategy systems, templates and pre-existing intellectual property unless expressly assigned in writing.
May transfer after full payment.
Subject to scope, platform limits and third-party licenses.
Retained by SkyInkCreations.
Reusable components and internal frameworks are not automatically assigned.
Controlled by external providers.
Licenses and terms may remain separate from SkyInkCreations delivery.
Hosting, maintenance and ongoing support.
Unless ongoing hosting, maintenance, support or retainer services are specifically agreed in writing, SkyInkCreations is not responsible for ongoing updates, monitoring, backups, security, content edits, third-party issues or future support after project completion.
Ongoing support requires an active agreement, active retainer, paid support arrangement or written approval from SkyInkCreations.
Completed websites may require ongoing updates, backups and security management.
Support is not unlimited unless expressly agreed in writing.
Emergency, urgent or out-of-hours work may attract additional charges.
Hosting and maintenance responsibilities must be clearly agreed before launch or handover.
Limitation of liability.
To the maximum extent permitted by law, SkyInkCreations is not liable for indirect, incidental, consequential or economic losses, including loss of revenue, loss of profit, loss of data, lost opportunity, business interruption, platform downtime, search ranking changes or third-party service failures.
The Client is responsible for ensuring that any website, software, content, offer, claim, policy, compliance requirement or business process is suitable for their industry, market and legal obligations.
SkyInkCreations provides professional digital services, but the Client remains responsible for business, compliance and operational decisions.
Hosting providers, platforms, APIs, payment processors and other external systems may create issues outside SkyInkCreations' control.
Australian Consumer Law.
Nothing in these Terms & Conditions excludes, restricts or modifies rights that cannot be excluded under Australian Consumer Law.
Where required by law, remedies will be provided strictly in accordance with statutory obligations.
Clarify the terms before making payment.
Contact SkyInkCreations before making payment if you need clarification around scope, deposits, ownership, support, third-party tools, project timelines or legal terms.
